If someone is in detention but hasn't yet moved out of their home for good they aren't counted for Council Tax.

People in detention are:

  • held awaiting deportation

  • held under the Mental Health Act.

It does not include:

  • someone who is in police custody waiting to be remanded

  • someone who is in prison for not paying of their Council Tax or a fine.

If there is another adult over 18 living in the home they may be able to get a Council Tax discount.

If everyone from the home has been detained, the property is exempt from Council Tax.
